WHEREAS, the Student Environmental Action Coalition has asked for a referendum to create a Renewable Energy Student Fee; and

WHEREAS, should the referendum pass there needs to be a structure in place for the management, disbursement, and accountability of the fee; and

THEREFORE, BE IT ENACTED BY THE STUDENT CONGRESS OF THE UNIVERSITY OF NORTH CAROLINA AT CHAPEL HILL THAT:

The following sections be added to Title II, Article XII:

Section 434. Renewable Energy Special Project Committee.

A. Purpose. The purpose of the Renewable Energy Special Projects Committee (RESP) shall be to increase the use of renewable energy on campus through creation and funding of projects on campus and to oversee the purchase of renewable energy from power providers.

B. Subject to the approval of the Student Affairs Committee and the Student Congress the Speaker shall appoint a Chair and two (2) additional members to the Renewable Energy Special Projects Committee.

C. Subject to the approval of the Student Affairs Committee and the Student Congress the Student Body President shall appoint two (2) members to the Renewable Energy Special Projects Committee.

D. Subject to the approval of the Student Affairs Committee and the Student Congress the Graduate and Professional Student Federation President shall appoint two (2) members to the Renewable Energy Special Projects Committee.

E. The Vice Chancellor for Campus Services, the Director of Energy Services, and the Sustainability Coordinator or their designees and any other faculty, staff, or administration members the Chair deems appropriate shall serve as non-voting ex-officio members of the Renewable Energy Special Projects Committee.


BE IT FURTHER ENACTED THAT:

The following sections be added to Title IV, Article III:

Section 248. Renewable Energy Special Projects Committee. Subject to the approval of the Student Affairs Committee and the Student Congress the Student Body President and the GPSF President shall each appoint two (2) members to the Renewable Energy Special Projects Committee.

BE IT FURTHER ENACTED THAT:

Title VI, Article X, Section 1001 be created:

Section 1001. Renewable Energy Fee Retention Referendum. Beginning in 2006 and every two (2) years thereafter a referendum shall be placed on the ballot during the regular student body election which shall read:

“Do you approve or disapprove of retaining the Renewable Energy Fee at the current rate of $___ per student per semester?”

No action shall be required of the Student Congress, the Student Body President, or any other SG official for this referendum to be placed upon the ballot.

In the event the referendum required in this section shall fail, this section shall immediately be stricken from the code.
